Force Majeure - Interruption of operations at the Givet pipe mill

 

Dear Sir or Madam,

On Thursday 15 July 2021, our Givet production site has been flooded due to the continuous heavy rain over the last 2 days. As a result, production facilities and all electrical equipment were shut down. Fortunately, no persons have been harmed.

Due to the gravity of these events, the local authorities of Fromelennes requested for the state of natural disaster as defined by Article 125-1 of the French Insurance Code to be recognized. By a decree dated July 23, 2021, published in the Official Journal on August 1, 2021, the state of natural disaster was recognized by the French government for several municipalities, including the Fromelennes.

Against this background, we have to inform you as a precautionary measure that due to this event there will be production downtimes and thus delivery delays. Our entire team is doing everything in its power to keep the effects of the disruption for you as low as possible. 

As a result of their external, unforeseeable, and irresistible nature, these exceptional events are susceptible to temporarily suspend the execution of our contractual obligations, and are a case of force majeure in accordance with Article 1218 of the French Civil Code.
